It could be over-ridden, and no it's not 'house rules only'. GW allows a 'counts as rule' wherein you can allow certain bits to represent a piece of wargear, so long as you clearly state what it is.
To use my classic example... Say I want lightning claws on a veteran sergeant... But I don't want to use actual lightning claws, and wanted to have him dual wielding swords. So long as the swords are both painted w/ power fields are something to mark them out as power weapons, and suitably ornate, the 'counts as' rule allows me to make the sarge dual wield swords that are actually lightning claws. You just have to point out the model to your opponent and tell him what the actual wargear is.
Be sure, however, to use this rule sparsely... Over using it is kinda cheesy.
